Welcome! This page outlines the standard terms of service for any design project. By engaging with our creative services, you agree to the following terms. They have been designed for clarity, fairness, and to protect the interests of both parties. We recommend that you review these terms in full before starting any project. Any questions or clarification, please get in touch.

Payment Terms

Deposit & Payment Structure: Payment terms vary. We reserve the right to request a deposit or partial payment before commencing work. Specific payment modes (hourly, milestone-based, fixed fee) will be confirmed for each project.

Late Payments: Invoices are due within the stated period (typically 20th of the following month). If payment is not received within 20 days, a late fee of 5% of the outstanding amount may be applied. Persistent non-payment may result in work suspension or recovery actions. All costs incurred in the recovery of overdue accounts will be added to the total amount owed.

Ownership: Completed work remains the property of Plenty Creative until full payment is received.

Fonts, Licensing & Source Files

Font Licensing: If your project includes licensed fonts, we’ll let you know upfront. You’ll need to purchase your own licence if you want to use those fonts in editable formats (like websites or in-house design).

We can’t share fonts we’ve purchased ourselves, as that breaches licensing laws. Fonts used in logos are usually outlined and don’t require a separate licence unless you plan to use them elsewhere.

Stock Images & Licensed Elements: We may use licensed photos or design elements in mockups. If you’d like to use them in final designs, you’ll need to purchase the appropriate licences. We’ll let you know where to find them.

Source Files: Unless otherwise stated, editable files (e.g. source files in .IDD, .AI, .PSD files) are typically not supplied unless separately arranged and licensed.

Timelines, Pauses & Communication

We allocate time and resources based on agreed timelines, whether your project is hourly or packaged.

If there’s no response from you for more than 14 days, the project may be paused, and you may lose your place in the project schedule. After 30 days of no communication, the project may be considered closed. To resume, any outstanding invoices must be paid and a new timeline agreed.

Confidentiality

Both parties agree to maintain the confidentiality of all sensitive information. This includes internal documents, creative processes, pricing structures, and any other proprietary information shared during our collaboration.

Cancellation & Termination

Client-Initiated Cancellation: If you choose to cancel a project, you will be invoiced for all work completed to date. Any remaining portion of a deposit will be refunded where applicable.

Termination: We reserve the right to terminate a project if the working relationship becomes unproductive or if expectations and scope become misaligned, even after reasonable attempts to resolve issues.

Approval Requirement: Final files and published work will only be released after confirmed client approval and full settlement of the invoice.

Automation in Design

We occasionally use automation or AI-supported tools to enhance parts of our creative process. These are simply tools that help streamline certain steps. All creative decisions, direction and final work are fully human-led and carefully refined to meet our quality standards.

Disclaimers

The clients is responsible for reviewing and approving all final designs before they are published or sent to print. Once you approve the work, Plenty Creative is not liable for any errors or variations that occur thereafter.

Client Proofing: While every effort is made to ensure the accuracy of files (including colour fidelity) for print, it is ultimately your responsibility to review and approve proofs prior to printing.

Managed Printing: If Plenty Creative manages your printing, we take responsibility for ensuring that printed outputs closely match the approved design.

Subcontractors & Collaboration

On larger projects, certain specialist tasks may be subcontracted. Any such subcontractors will be bound by confidentiality agreements and standards consistent with these terms. While subcontractors work under our supervision, all contractual obligations remain with Plenty Creative.

Limitation of Liability

While we strive for excellence, Plenty Creative shall not be liable for:

  • Any indirect, incidental, or consequential losses arising from our services.

  • Production or printing errors post-final approval (except when directly managed by us).

  • Any legal disputes concerning brand naming or IP outside our control.

The total liability under any claim will not exceed the fees paid for the specific project.

Quotes, Printing & Merchandise Estimates

Prices for print and merchandise do not include shipping unless otherwise stated. Design prices are estimates only and are based on the information provided by the client at the time of quoting. For printed orders, stock quantities, colours and delivery timeframes are not guaranteed at the time of quoting.
All pricing is in NZD and excludes GST unless otherwise stated.

Printed proofs (hard copy) are digitally produced and available as an optional extra, which can be estimated at the time of quoting.

If an artwork file is resupplied after the print process has commenced, a $30 fee may apply.

Revisions & Creative Feedback (Packages)

Standard Revisions: Your package includes a set number of revisions. Minor revisions (e.g. small copy tweaks, colour changes, layout adjustments) and major revisions (e.g. significant creative rework or changes post-approval) are defined in the project brief.

Additional Revisions: Extra changes will be billed at our standard hourly rate or an agreed flat fee. We communicate any additional charges before proceeding.

Copyright & Licensing (Branding)

Transfer of Copyright: Upon receipt of final payment, full copyright ownership of the final approved artwork is transferred to you, this is provided in a specific signed document.

Retained Rights: All developmental work, unused concepts, initial drafts, and working files remain the copywriters property of Plenty Creative indefinitely.

Portfolio Use: We reserve the right to showcase final work in our portfolio, on our website, or via social media unless you provide written instructions to the contrary.

Brand Naming & Legal Checks

Naming Services: While we assist with brand or product naming and perform basic checks (such as domain availability), you remain responsible for all legal checks and trademark registrations.

Legal Responsibility: It is your responsibility to verify that the chosen name does not conflict with existing trademarks or legal restrictions.
